Right of Withdrawal
The Right of Withdrawal is stipulated in Article 48, Paragraph 4, of Law No. 6502 on Consumer Protection (“Law”), titled “Distance Contracts.” According to this provision, the consumer has the right to withdraw from the contract within fourteen days without providing any justification and without paying any penalty. Notification of the exercise of the right of withdrawal to the seller or provider within this period is sufficient. Furthermore, various provisions of the Regulation on Distance Contracts (“Regulation”), enacted pursuant to the Law and enacted upon publication in the Official Gazette dated November 27, 2014, regulate the scope, exercise, and exceptions to the Right of Withdrawal. Article 15 of the Regulation stipulates the circumstances in which the Right of Withdrawal cannot be exercised. According to paragraph (ç) of the relevant article, consumers cannot exercise the Right of Withdrawal “in contracts concerning the delivery of goods whose protective elements, such as packaging, tape, seal, or package, have been opened after delivery; and those whose return is unsuitable for health and hygiene reasons.” Since the subject of the Distance Selling Contract (“Contract”) to which this Right of Withdrawal and Return Policy is an annex concerns food products, and since the return of such products would not be appropriate for health and hygiene reasons if protective elements such as packaging, tape, seal, or package have been opened after delivery, the Consumer DOES NOT HAVE A RIGHT OF WITHDRAWAL under this Contract for products whose packaging, tape, or protective element has been opened. However, you may return the product you have purchased within fourteen (14) days from the date of delivery, in the same condition as you received it, without opening/destroying/damaging/damaging the packaging/protective element, and without using the product.

Return Procedures

If the product you purchased meets the above conditions, you can initiate the return process by sending the “Notification of Withdrawal” provided in Annex 1 or by clearly stating that you have exercised your right of withdrawal to info@dirkali.com. Within 10 (ten) days of submitting the notice of withdrawal to us, you must send the product for which you wish to exercise your right of withdrawal to the address specified by the seller via Aras Cargo, using the return code you request from info@dirkali.com.

Since the Buyer is obligated to return the product in the same condition as when it was delivered, the Seller reserves the right not to accept the return if the returned product and its packaging are found to be opened, damaged, broken, damaged, torn, used, or otherwise, and/or if the product cannot be returned in the same condition as when it was delivered to the Buyer. Therefore, if the products you have returned to us exercising your right of withdrawal are deemed suitable for return after inspection, your return will be approved, and the product price you have paid will be refunded to you. If the return conditions specified above are met and your return request is properly submitted to us, your return will be approved and your refund will be processed. Your payment for the product will be refunded to your credit card or bank account, depending on your payment method, within 14 days of your request. The time it takes for the refund to reach you may vary depending on your bank.
